Amy J. Benjamin is the founding partner of Benjamin Law PC. and has more than thirty years of experience in intellectual property law, advertising law and First Amendment law matters.
Ms. Benjamin’s practice focuses on all areas of intellectual property law including trademark, copyright and unfair competition, advertising and First Amendment litigation, counseling and procurement. She has significant experience with Internet, new media and on-line matters such as key word and pop-up advertising and domain name issues. Ms. Benjamin manages significant trademark portfolios with U.S. and foreign trademark prosecution, provides clearance opinions and counseling services to her clients. She has extensive litigation experience of intellectual property matters in Federal court and before the Trademark Trial and Appeal Board, including trying cases before a jury. She is also experienced in advertising and packaging review, pre-publication review, licensing and due diligence for corporate matters.
Ms. Benjamin received her J.D. in 1989 from New York University School of Law, where she had a fellowship in Libel Law. She received a B.A. in American Studies, cum laude, from Brandeis University in 1986.
Ms. Benjamin is actively involved in the American Bar Association Intellectual Property Law Section, the New York Intellectual Property Law Association, the American Intellectual Property Law Association and the International Trademark Association, where she has held various committee, board, council and division chair positions.
Ms. Benjamin frequently speaks and writes on intellectual property issues and has been published in the National Law Journal, the Licensing Journal, Metropolitan Corporate Counsel, Bright Ideas and Euro Watch. On behalf of the America Intellectual Property Law Association, she authored an amicus brief filed with the with the United States Supreme Court in Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd.
Ms. Benjamin is admitted to the courts of the State of New York, the United States District Court for the Southern, Eastern and Northern Districts of New York and the Eastern District of Michigan, and the United States Court of Appeals for the Second, Ninth and Federal Circuits.
Prior to forming Benjamin Law PC, Ms. Benjamin was a partner at Darby & Darby PC, an intellectual property boutique and an associate in the intellectual property group of Skadden, Arps, Slate, Meagher & Flom.
Ms. Benjamin was named as a New York Super Lawyer in intellectual property in 2006, 2010, 2014 and 2015 and is a member of Who’s Who.
